O2 issues data breach information

O2 have issued a statement on this morning’s revelations regarding their sending your phone number to every website you browse on a phone connected to O2.

There is a link to the statement below, but the key points are:

  • this has been going on since 10th January 2012
  • it was caused by a network update that had unintended consequences
  • it was fixed as of 2pm today (25/1)
  • O2 are co-operating fully with the Information Commissioner on this matter

So they have broken their own terms and conditions based on using our private information, which my phone number definitely is, and passing it to 3rd parties without my consent?
So in theory I could cancel my contract as they have broken the legal contract between me and o2?
They could be facing a massive fine here, not withstanding the obviously legal action from o2 customers?
